Terms of Service

Kafunda is a product of Sprint S.P Telecom (“Sprint”, “we”, “us”), a company incorporated in Uganda. These Terms of Service (“Terms”) are an agreement between Sprint and the organisation that creates an account on the Kafunda platform (“Organisation”, “you”). By creating an organisation on Kafunda, or by continuing to use the platform, you accept these Terms on behalf of the Organisation. If you do not have authority to bind the Organisation, do not proceed.
Sprint's Data Processing Addendum (“DPA”)is incorporated into these Terms by reference and governs how Sprint handles personal data belonging to the Organisation's own end users. Read it alongside this document. The two are meant to be read together, not separately.
1. What Kafunda is
Kafunda is a platform for MikroTik-based internet service and hotspot operations, built and operated by Sprint. It manages router setup, network authentication, hotspot vouchers and PPPoE subscriber accounts, mobile money payment collection, and reporting for the Organisation's sites.
Sprint is not an internet service provider. The Organisation is the entity providing internet access, hotspot service, or PPPoE service to its own customers. Sprint supplies the software and infrastructure that makes that possible.
2. Account and eligibility
The Organisation must provide accurate information when creating an account, including a working contact email and phone number for the account owner. The Organisation is responsible for all activity under its account, including actions taken by staff or contractors the Organisation grants access to.
The Organisation must have the legal right to operate the network it registers with Kafunda: the necessary licences, if any are required in its jurisdiction, and lawful control of the sites and routers it connects.
3. Router setup and access
Adding a site to Kafunda produces a setup script the Organisation runs on its own MikroTik router. Running it connects the router to Sprint's servers and configures the authentication and accounting needed for hotspot and PPPoE access.
The Organisation is responsible for the physical security of its routers and for restricting access to the router to authorised staff. Sprint is not responsible for changes made to a router outside the configuration Kafunda applies.
The Organisation may remove a site at any time, which reverses the configuration Kafunda added to the router.
4. Hotspot vouchers, PPPoE subscribers, and end users
The Organisation is solely responsible for its relationship with its own end users, the people who buy hotspot vouchers or subscribe to PPPoE service through the Organisation's network. This includes setting prices, defining service terms, handling customer complaints, and ensuring the Organisation has told its end users what happens to their data.
Kafunda's hosted payment page displays a data notice to end users on the Organisation's behalf, covering what Sprint collects and why, as described in the DPA. The Organisation must not disable, hide, or alter this notice, and must not represent to end users that the notice does not apply.
The Organisation is responsible for verifying, to the extent required by applicable law, that it has a lawful basis to collect and process its end users' personal data through Kafunda. Sprint processes that data as instructed by the Organisation, subject to the DPA.
5. Payments and mobile money
Kafunda integrates with Yo! Payments to collect mobile money payments from end users on the Organisation's behalf, and to process withdrawals to the Organisation's registered payout details.
Sprint deducts a platform fee from collected payments before settlement to the Organisation's wallet. The current fee is stated in the Organisation's dashboard and may be changed with at least thirty days' notice. Settlement timing depends on Yo! Payments' processing and is not guaranteed to a fixed schedule.
The Organisation is responsible for reconciling its own wallet balance and reporting any discrepancy within thirty days of the transaction in question. Sprint is not liable for payment failures, delays, or disputes caused by the mobile money network operator or by incorrect payout details supplied by the Organisation.
6. Fees and billing
Flat platform subscription fees or transaction fee percentages apply to Organisation accounts, as specified in your dashboard configuration. Platform fees are debited automatically from the Organisation wallet. Failure to pay outstanding subscription invoices within 14 days of issue will result in service suspension. All platform fee and subscription charges are non-refundable.
7. Acceptable use
The Organisation must not use Kafunda to:
- Provide network access for illegal purposes, including facilitating fraud, harassment, or the distribution of unlawful content.
- Interfere with authentication or accounting in a way that misrepresents session or usage data.
- Resell or sublicense the Kafunda platform itself, as distinct from reselling internet or hotspot access built on top of it.
- Attempt to access another Organisation's account, router, or data without authorisation.
Sprint may suspend or terminate an account for a material breach of this section, after giving notice where the breach does not present an immediate risk to Sprint's infrastructure or to other Organisations.
8. Service availability
Sprint does not guarantee uninterrupted availability. Router connectivity depends on the Organisation's own network conditions, and Sprint's own infrastructure may require maintenance or experience outages. Where Sprint offers a service level agreement, it is set out separately and takes precedence over this section for the Organisations it covers.
9. Data protection
Sprint processes personal data belonging to the Organisation's staff and end users in accordance with the DPA and applicable law, including the Data Protection and Privacy Act, 2019 (Uganda). The Organisation, as data controller for its end users' data, remains responsible for the lawfulness of its own collection and use of that data, independent of Sprint's processing obligations under the DPA.
10. Intellectual property
Sprint owns the Kafunda platform, including its software, documentation, and branding. The Organisation owns its own business data, customer relationships, and any content it uploads. Nothing in these Terms transfers ownership of the Organisation's data to Sprint.
11. Liability
To the extent permitted by Ugandan law, Sprint's total liability to the Organisation arising from these Terms is limited to the fees paid by the Organisation to Sprint in the three months preceding the claim. Sprint is not liable for indirect or consequential losses, including lost revenue from network downtime, unless caused by Sprint's gross negligence or wilful misconduct.
Nothing in this section limits liability that cannot be limited under Ugandan law, including liability for death or personal injury caused by negligence, or liability arising from fraud.
12. Termination
Either party may terminate on thirty days' written notice. Sprint may terminate immediately for a material breach of Section 7, non-payment of fees after notice, or where continued service would expose Sprint to legal risk.
On termination, the Organisation may export its data for 30 days before Sprint deletes it, except where retention is required by law or the DPA. Site removal remains available to the Organisation up to the point of termination.
13. Changes to these Terms
Sprint may update these Terms from time to time. Material changes will be notified to the Organisation's registered account owner at least fourteen days before taking effect. Continued use of the platform after that date constitutes acceptance.
14. Governing law
These Terms are governed by the laws of the Republic of Uganda. Disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Uganda, unless the parties agree in writing to an alternative dispute resolution process.
